1. Agreement to Terms

By accessing or using boxly.games and its subdomains (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Boxly Games ("Boxly," "we," "us," or "our"). Please read them carefully.

2. Eligibility and Age Requirements

2.1 Minimum Age for Accounts

You must be at least 13 years of age to create a Boxly account. By creating an account, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2.2 Anonymous Gameplay

Users of any age may play games anonymously on boxly.games without creating an account. Anonymous gameplay does not require you to provide any personal information.

2.3 Parental Responsibility

Parents and guardians are responsible for supervising their children's use of the Service. If you allow your child to use the Service, you agree to these Terms on their behalf and are responsible for their activity.

3. Accounts

3.1 Account Creation

To save your progress and earn coins across devices, you may create a Boxly account by providing your email address. We will send you a magic link (a one-time sign-in link) — we do not use passwords.

3.2 Account Security

You are responsible for maintaining access to the email account associated with your Boxly account. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.

3.3 Account Restrictions

You may not:

Create multiple accounts to circumvent restrictions, abuse game mechanics, or manipulate the coin system
Share your account credentials or magic-link sign-in links with others
Use another person's email address without their permission
Impersonate another person or misrepresent your identity or age
Transfer or sell your account to another person

4. Virtual Currency (Coins)

4.1 Nature of Coins

Boxly games feature a virtual currency called "Coins." Coins are a feature of the Service and are not real currency, property, or financial instruments. Coins have zero monetary value and do not constitute stored value, e-money, or a payment instrument under any applicable law.

4.2 Earning Coins

Coins are earned through gameplay only. Earning rates are subject to server-side anti-cheat limits (currently 100 coins per minute per game). We reserve the right to adjust earning rates at any time.

4.3 Coin Restrictions

Coins:

Cannot be exchanged for real currency, goods, or services outside the Service
Cannot be transferred, traded, or gifted between users
Cannot be purchased with real money (payment features are not currently active)
May be used for in-game features as they become available
Are shared across all Boxly games in a single wallet

4.4 Coin Balance

Your coin balance is calculated as the sum of all your coin transaction records. We maintain an append-only transaction log for integrity. You can view your balance within any Boxly game while signed in.

4.5 Forfeiture of Coins

All accumulated coins are forfeited and permanently lost if:

Your account is terminated by Boxly for violating these Terms
You delete your account (account deletion removes all coin transaction records)
Coins were earned through cheating, exploitation, or abuse (we reserve the right to reverse fraudulent transactions)

Because coins have no monetary value, you are not entitled to any compensation, refund, or credit for forfeited coins under any circumstance.

4.6 Modifications to the Coin System

We reserve the right to modify, suspend, or discontinue the coin system (including earning rates, balances, and redemption options) at any time, with or without notice. If we discontinue the coin system entirely, all coin balances will be forfeited with no compensation.

5. Acceptable Use

You agree not to:

Cheat or exploit — use cheats, hacks, bots, scripts, automation software, or any unauthorized tools to manipulate games, inflate scores, or earn coins fraudulently
Attack our systems — attempt to gain unauthorized access to our servers, databases, APIs, or other users' accounts; perform denial-of-service attacks; or probe for vulnerabilities without permission
Reverse engineer — decompile, disassemble, reverse engineer, or attempt to derive the source code of any part of the Service, except as permitted by applicable law
Circumvent security — bypass, disable, or interfere with any security features, anti-cheat mechanisms, rate limits, or access controls
Scrape or harvest — use automated tools to scrape, crawl, or extract data from the Service
Misuse the Service — use the Service for any illegal, fraudulent, or unauthorized purpose, or in any way that violates these Terms or applicable law
Interfere with others — disrupt the experience of other users or interfere with the proper functioning of the Service

6. Intellectual Property

6.1 Our Content

All games, graphics, characters (including the Boxly mascot and its variants), animations, sounds, music, code, text, logos, trademarks, and other content on the Service (collectively, "Boxly Content") are owned by Boxly Games or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment purposes only. This license does not include the right to:

Reproduce, distribute, or publicly display Boxly Content
Create derivative works based on Boxly Content
Use Boxly Content for commercial purposes
Remove, alter, or obscure any copyright, trademark, or other proprietary notices

6.3 Content Creators

You may create and share gameplay videos, screenshots, and streams of Boxly games for non-commercial purposes (e.g., personal social media, YouTube, Twitch) provided you credit Boxly Games. We reserve the right to revoke this permission at any time for any reason.

7. Advertising

The Service displays advertisements, including:

Rewarded video ads — optional ads you choose to watch in exchange for in-game benefits (e.g., a second chance, bonus coins)
Interstitial ads — ads displayed between gameplay sessions

Ad availability, formats, and frequency may vary by platform, region, and time. We reserve the right to modify ad placements at any time. Ad content is provided by third-party ad networks and does not represent endorsement by Boxly.

8. Third-Party Platforms

Boxly games may be available on third-party platforms, including CrazyGames. When you play Boxly games on a third-party platform:

That platform's terms of service and privacy policy also apply
Features may differ from the boxly.games experience (e.g., no Boxly accounts, different ad providers)
We are not responsible for the practices, policies, or content of third-party platforms
Any disputes related to the third-party platform should be directed to that platform

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOXLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by law. If you are a consumer in the EEA or UK, your statutory rights under mandatory consumer protection law are not affected by these disclaimers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOXLY GAMES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data, coins, game progress, or account information
Loss of revenue, profits, or business opportunities
Personal injury or property damage related to use of the Service
Unauthorized access to or alteration of your data
Any other damages arising from your use of or inability to use the Service

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BOXLY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Boxly Games and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your violation of these Terms
Your use or misuse of the Service
Your violation of any third party's rights or applicable law

This indemnification obligation applies to the fullest extent permitted by applicable law. If you are a consumer in the EEA or UK, this section applies only to the extent that your actions were intentional or negligent.

12. Account Suspension and Termination

12.1 Termination by Boxly

We may suspend or terminate your account and access to the Service, without prior notice, if we reasonably believe that:

You have violated these Terms
Your account is being used for cheating, fraud, or abuse
You are under 13 years of age and have created an account
Continued access poses a risk to the Service or other users

Upon termination for cause, all coin balances are forfeited. We will make reasonable efforts to notify you of the reason for termination, unless doing so would compromise security or an investigation.

12.2 Termination by You

You may stop using the Service at any time. To delete your account and all associated data, send an email to [email protected] with the subject line "Account Deletion Request" and include the email address associated with your account in the body. See our Privacy Policy for full details on the deletion process.

12.3 Effect of Termination

Upon termination (whether by you or by us):

Your right to use the Service ceases immediately
All accumulated coins are forfeited
Sections that by their nature should survive (including Sections 4.5, 6, 9, 10, 11, 14, and 15) will continue to apply

13. Modifications to the Service and Terms

13.1 Changes to the Service

We reserve the right to modify, update, suspend, or discontinue any part of the Service (including games, features, and the coin system) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuance of the Service.

13.2 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

Update the "Last updated" date at the top of this page
Post a prominent notice on boxly.games for at least 30 days
Where required by law (e.g., for EEA/UK consumers), provide specific notice and/or obtain consent

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Dispute Resolution

If a dispute arises, we encourage you to contact us first at [email protected] so we can try to resolve it informally. If we are unable to resolve the dispute within 30 days, either party may pursue formal resolution.

14.3 Consumer Rights

If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms affects your statutory rights. You may bring claims in the courts of your country of residence, and the mandatory consumer protection laws of your jurisdiction will apply regardless of the governing law clause above. EU consumers may also use the European Commission's Online Dispute Resolution platform.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boxly regarding the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power outages, internet disruptions, or third-party service failures.
